CANTLIN LAW FIRM OBTAINS $1.2 MILLION  WRONGFUL DEATH SETTLEMENT  ON BEHALF OF LOCAL FAMILY

 

After successfully winning multiple motions in the days leading up to trial, Attorney John L. Cantlin and Timothy B. Cantlin of the Cantlin Law Firm, obtained a $1,200,000.00 settlement on behalf of a daughter and son for the wrongful death of their 71 year-old father.

The decedent was backed over by a grain truck as it was backing into the field as the driver of the grain truck lost sight of the decedent, failed to stop his vehicle, and backed over the decedent crushing him under the grain truck and killing him.

The Cantlin Law Firm pursued recovery on behalf of the family under the Illinois Wrongful Death Act, and the Illinois Survival Act. Despite the fact that the decedent walked behind the grain truck, the Cantlin Law Firm, through its investigation and retained expert in the field of Commercial Motor Vehicle Operation, were able to prove the driver of the grain truck violated the standard of care expected of a reasonable, prudent, well trained, commercial motor vehicle operator, and that the driver of the grain truck violated provisions of the Federal Motor Carrier Safety Regulations (FMCSR) and violated provisions of the Illinois CDL Manual.
