CANTLIN LAW FIRM OBTAINS WRONGFUL DEATH SETTLMENT  IN TRUCK ACCIDENT AGAINST CORPORATION AND ITS DRIVER

 

Attorneys John L. Cantlin and Timothy B. Cantlin of the Cantlin Law Firm, obtained a settlement on June 20, 2017 on behalf of a family for the wrongful death of a 61-year-old husband and father killed in a 2015 truck versus car accident. The case settled prior to a jury trial in the Circuit Court of the Thirteenth Judicial Circuit of LaSalle County, Illinois.

On May 29, 2015 around 11:24 a.m., an employee of MedPro Waste Disposal, LLC, (MedPro) was driving a 2013 Isuzu NPR Commercial Box Truck northbound on Illinois Route 23 North of Ottawa. The MedPro driver, Frank M. Contacessi, failed to stop and slammed into the back of a 2001 Buick LeSabre driven by a 61 year old male waiting to make a left hand turn. He was pronounced dead at the scene and is survived by his wife, a daughter and son.

Evidence developed throughout the litigation by the Cantlin Law Firm was instrumental in obtaining the settlement. Plaintiff’s reconstruction of the accident in connection with the Fleet Management System installed on MedPro’s vehicle, and forensic analysis of MedPro driver’s cell phone refuted the MedPro driver’s version of the accident. Plaintiff’s investigation established the MedPro driver failed to keep a proper look out as a result of being distracted by use of his cellular telephone, specifically that he was drafting text messages just prior to and at the time of the accident.

The defendant, MedPro Waste Disposal, LLC, and Frank M. Contacessi were represented by Scott Brown of Cassidy Schade LLP from Chicago IL.

The amount of the settlement is not being disclosed at the request of the family.
