CANTLIN LAW FIRM OBTAINS WRONGFUL DEATH SETTLEMENT AGAINST CHICAGO AREA NURSING FACILITY

Attorneys John L. Cantlin and Timothy B. Cantlin of the Cantlin Law Firm, obtained a settlement on behalf of a family for the wrongful death of a developmentally disabled 50-year-old against a Chicago Area Nursing Facility. The case was settled in May of 2017.

On January 25, 2015, the Decedent was a resident of the nursing facility and was limited to a pureed diet by his primary care physician. The Decedent found unresponsive in the dining area of the nursing facility by the nursing staff. It was determined that the cause of death was aspiration of a food bolus as a result of the decedent obtaining a peanut butter and jelly sandwich at the facility.

The Cantlin Law Firm pursued recovery on behalf of the family under the Illinois Wrongful Death Act, the Illinois Survival Act, and the Illinois Nursing Home Care Act. The focus of the litigation was on the negligent and careless supervision of the Decedent by the facility.

The Nursing Facility was represented by Robert J. Kelleher of Quintairos, Prieto, Wood & Boyer, P.A. from Chicago. The settlement is subject to a confidentiality provision.
